Protection of Results
According to the funding terms, each project party is obligated to examine the possibility to protect its Results (e.g. by patent) and when justified, adequately protect them. When considering if protection is justified, the party shall consider not only its own interests in protection but also the interests of the other project parties.
The university has neither the administrative nor the economic resources to seek intellectual protection for research results. The department therefore needs to transfer the Results to someone that has this capacity and is willing to accept the obligations to protect the results if such protection is to be carried out. In case the recipient of a Result does not fulfil these obligations, Uppsala university will still be responsible towards the European Commission.
To consider in regard of protection of Results:The department must plan for how it should handle the obligation to protect Results generated by its researchers within the project. Most appropriate a plan should include transferring the Result to someone who is more suited for protecting and that are willing to assume this obligation to protect Results.
