Transfer of Results
A project party will be considered the owner of any Results generated by its researchers within the project (se above Ownership of Results). The party may transfer the ownership.
In case of the university a transfer could be to the researcher/s at the university that is/are the originator/s of the Result or to one of the holding companies of the university. It should be noted that the other project parties must be notified of any transfer before the transfer takes place, and that under certain circumstances they may object to a transfer of ownership. The latter is the case provided that the university has not declared its intention to transfer the Results and has named future owners already in the consortium agreement. The consortium agreement usually includes an attachment where the parties can name presumptive future owners for this purpose.
In case of transfer of Results, the university must also transfer all the obligations accompanying the Results according to the funding terms. Amongst other things, this includes that the rights that other project parties have to use the Results within the current HE-project, that other parties may request licenses for use outside the project and any obligations in relation to protection and exploitation of Results that are included in the funding terms.
To consider in regard to transfer of Results:To avoid other project parties objecting to a transfer of Results, the department should use the possibility to name presumptive future owners of the Results in the consortium agreement. It is important that, when transferring ownership of a Result, the new owner fully understand and accepts the obligations that follow with the transfer in respect of the relevant funding terms and the terms of the consortium agreement relating to the Results.
