In recent years, law enforcement agencies in many jurisdictions have increasingly used facial recognition technology (FRT) in criminal investigations. This presentation examines both the opportunities and risks of investigative uses of FRT by drawing on U.S. legal debates and recent cases. Building on this analysis, it proposes elements of an appropriate regulatory (or doctrinal) framework.
